Ashton General Insurance Limited (AGIL) is a company registered in the Bailiwick of Guernsey under the Companies (Guernsey) Law 2008 and is regulated under the Insurance Business (Bailiwick of Guernsey) Law, 2002.

AGI is committed to protecting your privacy. This commitment reflects the value we place on earning and keeping the trust of our customers, business partners and others who share their personal information with us.
We are required under relevant data protection laws to produce this privacy notice (this “Notice”) to data subjects about whom we hold personal information.

What does this Privacy Notice do?

This Notice explains AGIL’s information processing practices. It applies to any personal information you provide to us and any personal information about you that we collect from other sources. This includes the brokers that supply us with information about your insurance cover and our agencies that we may employ when dealing with a claim.
This Notice is a statement of your rights regarding your personal information. This is not a contractual document, and it does not create any rights or obligations.
This Notice does not apply to your interaction with any third party that might be connected to AGIL, either directly or indirectly (for example any website that may be linked to any website that this Notice is published on) and you should refer to their specific privacy notice.

Who is responsible for your information?

Throughout this Notice,” AGIL” refers to AGIL Insurance Company AGIL is responsible for your personal information and is a Data Controller for the purposes of data protection laws.
Where we act as a data processor for a third party (namely the data controller) the third party is responsible for how personal information is processed and will have its own privacy notice.

When and how do we collect your information?

We will collect personal information when you purchase an insurance policy from one of our brokers. This information will include your personal details and details of the items that you wish to insure. We also collect information from you which will enable us to deal with any claim that you might submit either directly to us or through a broker.

What personal information do we collect?

Personal Information

The information we collect about you may include but is not limited to the following:

  • Personal details, such as your address telephone number and email, date of birth, age, gender, occupation, and nationality.
  • Financial details such as bank account information, credit history and bankruptcy status may be accessed either at policy inception or at the time of a claim.
  • Sensitive personal information such as criminal convictions and medical conditions as necessary in relation to insurances.

Where you provide us with personal information, we will request that you understand and give your explicit consent that we may use and if required disclose this information to third parties for the purposes agreed. If you provide personal information about other individuals such as persons listed on your insurance, you must obtain their consent prior to your disclosure to us.

Information we collect over AGIL online quote systems

We may ask you for some or all the following types of information when you request quotations or insurance cover. This includes, but is not limited to:

  • Contact information, such as name, e-mail address, postal address, phone number and mobile number; and the wearer of any item you wish to insure and full details of the item(s) you wish to insure.
  • Details of convictions and financial history for yourself, insured persons or members of your household.

In some instances, we will automatically collect certain types of information when you visit our websites and through e-mails that we may exchange. Automated technologies may include the use of web server logs to collect IP addresses. We may also collect information about you directly from Third Parties when assessing any application for insurance.

How do we use your personal information?

We process personal information which is provided to us from our brokers and Third Parties to enable us to:

  • Provide insurance quotations
  • Provide insurance cover
  • Process claims

The purposes for which your personal information is processed will be determined by by applicable laws, regulatory guidance, and professional standards.

AGIL relies on the following legal grounds to collect and use your personal information:

Legal basis

Processing of your personal information may be justified by a ‘lawful Basis’ for processing. In the majority of cases, processing will be justified on the basis that:

  • The processing is necessary for the performance of a contract to which you are a party, or to take steps (at your request) to enter into a contract.
  • The processing is necessary for us to comply with a relevant legal obligation (for example, where we are required to collect certain information about our clients  for tax or accounting purposes, or where we are required to make disclosures to courts or regulators); and / or
  • The processing is in our legitimate commercial interests, subject to your interests and fundamental rights.

How long we keep information about you

We will keep your information for as long as it is required to enable us to provide quotations, administer your insurances, offer renewal and respond to any claims or complaints (which may arise after the period of insurance has expired). This will usually be a minimum period of seven years or otherwise as determined by law or regulation. Once we decide that we no longer need your information it will be securely and confidentially destroyed. For more information on how we destroy your data, please contact our office.

You have certain legal rights under data protection law and regulations, summarised as follows:

  • The right to be informed about our data processing activities, including through Privacy Notices such as this.
  • The right of access to the personal information we hold about you. To request a copy of this information you must make a subject access request in writing to us.
  • The right of rectification. You may ask us to correct any inaccurate or incomplete data within one month.
  • The right to erasure and to restrict processing. You have the right to have your personal data erased and to prevent processing except where we have a legal obligation to process your personal information. You should bear in mind that by exercising this right you may hinder or prevent our ability to provide products and services.
  • The right to data portability. On your request, we will provide you with your personal data in a structured format.
  • The right to object. You have particular rights in relation to automated decision making and profiling to reduce the risk that a potentially damaging decision is taken without human intervention. You can object to your personal data being used for profiling, direct marketing or research purposes.

On receipt of your request, we will act without undue delay and in any event within one month. In most cases a fee will not be charged, except where the Data Subject Access Request is manifestly unfounded or excessive then a reasonable fee may be charged for administrative costs. You will be advised of any fee prior to us supplying the data.

Sharing information

We will only supply your personal information to other parties where such a transfer is a necessary part of the activities that we undertake, where you give us consent or where we are required to do so by law or regulation (e.g., where the disclosure is necessary for the purposes of the prevention and/or detection of crime).
We may disclose personal information to, business partners and other parties in order to provide our products and services and to enable you to enter into insurance contracts. Examples of other parties include other insurance intermediaries, loss adjusters, credit & identity checking agencies, regulatory bodies, finance providers, legal and accountancy practices, firms involved in the claims handling process and suppliers of replacement products following claims.
We may get and share details of any earlier home and motor policies and claims both directly with other insurers, and by using industry databases such as CUE (Claims Underwriting Exchange), or other registers of losses such as those covering watches. We may pass information relating to your insurance policy and any incident to the operators of these registers, their agents and suppliers.
We may also share your information with the Police and law enforcement agencies.
We may also disclose your information to service providers engaged to perform services on our behalf. Such service providers are contractually restricted from using or disclosing the information we give them except as necessary to perform services on our behalf or to comply with legal requirements.
We only share your information if we are satisfied that our partners or suppliers have sufficient measures in place to protect your information in the same way that we do.
We may also disclose personal information to new owners of our business in the event that we are subject to a merger or acquisition. Disclosure may also be made to enable company audits, regulatory inspections or to investigate a complaint, suspicion of fraud or a security threat.
We never share your information outside our organisation for marketing purposes.

Information from other sources

We may use legal public sources such as the electoral roll and other third-party sources such as credit reference agencies to obtain information about you, for example to verify your identity or check your credit history. We also obtain information about you from credit reference agencies and similar third parties. Some personal information may be provided to us by third parties such as other insurance companies, including other insurance intermediaries. In some cases, you will have previously submitted your personal information to them and given them approval to pass this information on for certain purposes.
Such information will only be obtained from reputable sources which operate in accordance with the General Data Protection Regulation.
We and/or other parties may use your information for purposes such as statistical and trend research and analysis which may include computerised processes which profile you. Automatic profiling helps us understand, predict and forecast customer preferences and to improve the products and services we offer and to assess which products might be most suitable for you. We may amend this Privacy Policy from time to time for example, to keep it up to date or to comply with legal requirements. This latest version was issued in December 2024.

Automated Decision Making

We may use automated decision making, including profiling, to assess insurance risks, detect fraud and administer your policy. This helps us decide whether to offer insurance, determine prices and validate claims.

Transfer of personal data outside of Guernsey

Certain personal information held on our Information Technology systems may be transferred across geographical borders in accordance with applicable law.
By providing us with your information, you consent to the collection, international transfer, storage, and processing of your information. These transfers are governed by European Union (EU) standard contractual clauses or equivalent data transfer agreements to protect the security and confidentiality of personal information.
